What is TUPE?
TUPE stands for the Transfer of Undertakings (Protection of Employment) Regulations 2006 and it’s there to protect the rights of employees when the business they work for has a change of ownership. What this means is that as an employer you are required to honour all of the terms and conditions that the employee had with the previous employer.
TUPE also applies when a service that is provided changes hands, this could be from contractor to contractor, in-house to contractor, or from a contractor back to in-house, a good example would be where an organisation decides to outsource their IT support.
