What is TUPE?

TUPE stands for the Transfer of Undertakings (Protection of Employment) Regulations 2006 and it’s there to protect the rights of employees when the business they work for has a change of ownership. What this means is that as an employer you are required to honour all of the terms and conditions that the employee had with the previous employer.

TUPE also applies when a service that is provided changes hands, this could be from contractor to contractor, in-house to contractor, or from a contractor back to in-house, a good example would be where an organisation decides to outsource their IT support.

Avoid costly mistakes

TUPE can be a complicated process and it’s very easy to make mistakes – don’t worry, we can help you with this. We know how important it is to treat your staff fairly and comply with the law, failure to do this can lead to employee tribunals and expensive compensation pay-outs. Our consultants will be able to walk you through each step of the process.

Our support for TUPE is included with our HR support package, however in more complicated situations where there may be a separate charge. We’ll happily talk through these differences with you.

TUPE can be a challenging process to get right and good planning really does help to ensure the transition runs as smoothly as possible. Our HR experts will help you put a plan in place that is right for your business.

When TUPE gets tough

Even with the best of plans, problems can still occur. We’re there on the other end of the phone to support you with any difficulties that you have, so you can rest assured knowing there is an expert who has your back.

Support with post-transfer changes

After the transfer it’s likely that there will be changes to make, it’s important that any changes your make are compliant with employment law, this is where we come in. Our team of HR experts are backed up by our inhouse legal team who have a wealth of experience, here when you need them, they’ll talk you through the changes you want to make, and advise you on the best course of action to take through your TUPE proceedings.

Advice and assistance with redundancies

You’ll need or want to improve the efficiency of the business or contract you are taking on – this can mean making one or more roles redundant. It’s important that businesses are efficient and able to survive and this means looking after roles which will allow your business to do this. Making roles redundant is an essential but difficult (and a potentially risky) process, fortunately we have extensive experience with this and our experts are there guide you through this part of the TUPE process (should you need it.)
